The Supreme Court of Canada has ordered a new trial for a man convicted of killing an aboriginal woman in Lloydminster.
Gordon Dwight Hurley was convicted in September of 2007 of fatally beating and strangling 20-year-old Jarita Naistus from the Onion Lake Cree Nation.
Her body was found in a hotel room on the morning of October 2nd, 2005.
However, the Supreme Court of Canada has ruled that the judge handling the original trial failed to properly warn the jury about some evidence given by a jailhouse informant.
Hurley’s lawyer Morris Bodnar argued the judge’s warning was not adequate.
He also says new DNA evidence has emerged that needs to be taken into consideration.
Bodnar says another bodily substance was found in the room that doesn’t belong to his client.
He says Hurley was emotional when informed he will get a new trial.
Bodnar says he hopes that can take place this year.
