PBCN Candidate Files Request For Judicial Review

A man who ran for chief of the Peter Ballantyne Cree Nation is calling for a federal court to review some aspects of the recent election.

 

Harold Linklater lost by 9 votes to incumbent chief Darrell McCallum.

 

However 48 of those ballots were spoiled.

 

Linklater says he has heard the ballots have since been destroyed.

 

He says he can’t believe this has happened when everyone knew he and others wanted the ballots to be examined.

 

In the court papers Linklater is calling on the electoral officer to preserve the ballots.

 

He’s also calling for the appeal committee’s decision not to hear his case to be quashed.

 

As well he wants a new hearing and his legal costs to be paid for.

 

“we filed, you know – to direct the electoral officer to preserve the ballots that were cast in the election.  And as it says there we did not agree with the decision that the appeal committee made.”

 

Linklater adds since the election has taken place he has lost his job as the band’s housing director.

 

Neither the chief nor the electoral officer was immediately available for comment.
