The decision in the case of a foster mother charged with criminal negligence causing the death of an Aboriginal toddler two years ago has been postponed.

Justice Neil Gabrielson was originally supposed to render a decision tomorrow in the case of Eunice Wudrich who was looking after 22-month-old Evander Lee Daniels of Sturgeon Lake First Nation when he was found drowned in a bathtub on June 8, 2010.

However, it was announced this morning that a decision in the case will now be made on Friday Feb. 1 at Court of Queen’s Bench in Saskatoon.

During the course of the trial, court has heard Wudrich was looking after six children, including five foster children under the age of five, at the time of Daniels’ death.

In closing arguments at the trial last week, Crown prosecutor Paul Goldstein argued it is never acceptable to leave a toddler unattended in a bathtub under any circumstances while defense lawyer Mark Brayford said Wudrich did indeed make a mistake but forgetfulness does not equate criminal negligence.
