A court of appeal has ruled in favour of a man convicted of a sexual assault.
Mitchell Moise won his appeal of his long-term dangerous offender status.
Moise argued the judge erred in determining Gladue considerations refusing to allow evidence to support his case.
Gladue considerations allows the court to consider cultural impacts in a person’s history.
Moise is of Cree and Saulteaux descent.
The date for the new hearing has not been set.
