A man convicted of manslaughter on Mistawasis First Nation from an incident more than 10 years ago will go back to court.
In 2012, Curtis Nataucappo was found guilty of manslaughter in the April 2001 stabbing and death of Alexander Ronald Sanderson.
Nataucappo was sentenced to 9 years in prison for the incident.
His lawyer appealed the decision arguing that oral statements made to police officers should not have been used as evidence.
The crown had used statements from Dwayne Badger who had been at the crime scene, but died prior to the trial.
The appeals judge agreed with Nataucappo’s argument and has ordered a new trial.
