The former bank and accounting firm that the Whitecap Dakota First Nation is suing, blames the band for allowing a $6 million fraud to happen.
The Royal Bank and KPMG filed separate statements of defense last month in Saskatoon.
The Royal Bank claims the Whitecap Dakota First Nation failed in its obligations to report inaccuracies in its account statements within 45 days.
The bank says the band allowed its accountant, Hugo Gallegos, to maintain and control the statements.
KPMG meanwhile, claims the blank cheque problem was created by Whitecap.
The band alleges the Royal Bank cashed more than 1700 cheques for Gallegos totaling $5.8 million.
The band’s suit also alleges KPMG should have uncovered the fraud earlier.
Gallegos pleaded guilty to the fraud and is serving a five-year sentence.
